Igni Terms of Use
1. These terms
These terms are an agreement between you and Burak Özaslan, who makes Igni at 1801 Labs ("we", "us"). By downloading or using Igni, you agree to them. If you don't agree, please don't use the app.
2. Igni is not an emergency service
Igni is not an emergency, medical or monitoring service. It never calls emergency numbers, and it does not detect falls, illness or any medical condition. It only tells the people you chose when you haven't lit your fire by the end of your grace period.
Igni can't guarantee that a reminder or an alert arrives, or arrives on time. Notifications depend on things outside our control, including your and your circle's devices, settings (such as notifications or Focus), network connections, Apple's Push Notification service and our server being reachable. Don't rely on Igni as your only way to get help or to check on someone. If you're worried about someone, call them, or call your local emergency number.
3. The licence and Apple's Standard EULA
Igni is licensed, not sold, to you through the App Store under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These terms add to the Standard EULA. Where they conflict in a way that affects your rights as an App Store user, the Standard EULA prevails.
You and we acknowledge that:
- These terms are between you and us only, not with Apple. We, not Apple, are solely responsible for Igni and its content.
- Your licence is limited to using Igni on Apple-branded devices that you own or control, as the Usage Rules in the App Store Terms of Service allow.
- Apple has no obligation to provide any maintenance or support for Igni. Support is provided by us (section 18).
- If Igni fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for Igni.
- We, not Apple, are responsible for addressing any claims relating to Igni or your use of it, including product liability claims, claims that Igni fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that Igni or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You agree to comply with any third-party terms that apply when you use Igni, such as your mobile carrier's.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
4. What Igni is
Igni is a daily check-in. You light your fire once a day in the app. If you haven't by the end of your grace period, our server tells the people in your circle through push notifications, and tells them "all good" when you light it. The people in your circle need the Igni app and must accept your invite before they receive anything.
5. Who can use Igni
You must be 18 or older and able to enter into a binding agreement in your country.
6. Your circle and consent
Invite only people you know and who agree to hear from you. Each of you can end the connection at any time. Use the names and labels in Igni respectfully, and don't use Igni to track, pressure or harass anyone.
7. Free features and Igni Pro
Igni is free to download. On the free plan, one person sees your fire, and you can watch as many fires as you like. Igni Pro is optional and adds up to 10 people who see your fire, auto check-in from Apple Health steps or heart rate, away mode longer than 7 days, and your battery level in alerts. It is offered as a monthly or yearly auto-renewable subscription. Prices are shown in the app before you buy, in your local currency.
- Payment is charged to your Apple Account when you confirm the purchase. If a free trial is offered, the first payment is charged when the trial ends, unless you cancel at least 24 hours before it ends.
- Auto-renewal: a subscription renews automatically for the same period at the end of each period unless it is cancelled at least 24 hours before the period ends. Your account is charged for the renewal within the 24 hours before the period ends, at the same price unless we told you about a change in advance.
- Manage or cancel at any time in your Apple Account settings: on iPhone, Settings → your name → Subscriptions → Igni, or Manage subscription in Igni's Settings. Cancelling stops the next renewal; Pro stays on until the end of the period you paid for.
- Restore purchases is on the Pro screen in the app. Use the same Apple Account you bought Pro with.
- Deleting your Igni account doesn't cancel the subscription. Cancel it with Apple first.
- If Pro ends, your account, your circle and your history stay, and Pro features stop. If more people see your fire than the free plan allows, only the first person you invited stays active. The others are paused: they get no news of your fire, including no alerts, and each of them is told once that your fire isn't visible to them for now. In the app, they show as "Needs Pro". They become active again as soon as you have room, by turning Pro back on or removing someone. You can't invite new people while you're over the limit.
All purchases are made through Apple and are also governed by Apple's terms.
8. Refunds
Purchases are processed by Apple, and we cannot issue refunds ourselves. You can request a refund from Apple at reportaproblem.apple.com. Your statutory rights as a consumer are not affected.
9. Your data
How Igni handles data, including the data our server stores and for how long, is described in the privacy policy. You can delete your account in the app at any time.
10. Fair use
Don't misuse Igni: don't try to break, overload, reverse engineer or interfere with the app, our server or Apple's services beyond what the law allows, and don't create accounts to get around the app's limits.
11. Our rights
Igni, its design, the fire, its code and name belong to us or our licensors. These terms give you a licence to use the app, not ownership of it.
12. Provided as is
Igni is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We work to keep the clock and the notifications reliable, but we can't promise that Igni is free of errors, that it will run without interruption, or that every notification is delivered (section 2).
13. Liability
We are liable without limit for intent and gross negligence, for personal injury or harm to health caused by our breach of duty, and where mandatory law says so. Otherwise, to the extent the law allows, we are not liable for indirect or consequential loss, or for a reminder or alert that isn't delivered or is late for reasons outside our control, and our total liability is limited to the amount you paid for Igni in the 12 months before the claim. This does not limit your statutory rights as a consumer.
14. Changes to Igni and these terms
We may update Igni and these terms. If a change is significant, we will show it in the app or on this page before it applies. The date above shows the latest version.
15. Ending
You can stop using Igni and delete your account at any time. We may end these terms with reasonable notice, or immediately for serious breaches, such as misuse under section 6 or 10. Sections 2, 8, 11, 12 and 13 continue to apply afterwards.
16. Law and disputes
These terms are governed by the laws of the Republic of Türkiye. The courts of Istanbul have jurisdiction, except where the consumer protection law of the country you live in gives you the right to bring a claim there. You keep the protection of the mandatory laws of your country of residence.
17. If part of these terms doesn't apply
If a court finds part of these terms invalid, the rest still applies.
