Filiy Terms of Use

1. These terms

These terms are an agreement between you and Burak Özaslan, who makes Filiy at 1801 Labs ("we", "us"). By downloading or using Filiy, you agree to them. If you don't agree, please don't use the app.

2. The licence and Apple's Standard EULA

Filiy is licensed, not sold, to you through the App Store under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These terms add to the Standard EULA. Where they conflict in a way that affects your rights as an App Store user, the Standard EULA prevails.

You and we acknowledge that:

  • These terms are between you and us only, not with Apple. We, not Apple, are solely responsible for Filiy and its content.
  • Your licence is limited to using Filiy on Apple-branded devices that you own or control, as the Usage Rules in the App Store Terms of Service allow.
  • Apple has no obligation to provide any maintenance or support for Filiy. Support is provided by us (section 16).
  • If Filiy fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for Filiy.
  • We, not Apple, are responsible for addressing any claims relating to Filiy or your use of it, including product liability claims, claims that Filiy fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • If a third party claims that Filiy or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • You agree to comply with any third-party terms that apply when you use Filiy, such as your mobile carrier's.
  • Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.

3. What Filiy is

Filiy is a habit tracker. Each habit you add grows as a plant that you water by doing it. Filiy does not give advice and is not a medical, health or treatment service. If you use Filiy for a habit related to your health, such as quitting smoking, talk to a professional for advice.

4. Who can use Filiy

You can use Filiy if you can enter into a binding agreement in your country, or if a parent or guardian agrees to these terms for you.

5. Free features and Filiy Pro

Filiy is free to download, with a free garden. Filiy Pro is optional and adds unlimited plants and islands, all species, creating shared gardens, widgets and the Control Center control. It is offered as a monthly or yearly auto-renewable subscription, or as a one-time lifetime purchase. Prices are shown in the app before you buy. There is no free trial.

  • Payment is charged to your Apple Account when you confirm the purchase.
  • Auto-renewal: a subscription renews automatically at the end of each period unless it is cancelled at least 24 hours before the period ends. Your account is charged for the renewal within the 24 hours before the period ends, at the same price unless we told you about a change in advance.
  • Manage or cancel at any time in your Apple Account settings: on iPhone, Settings → your name → Subscriptions → Filiy. Cancelling stops the next renewal; Pro stays on until the end of the period you paid for.
  • Restore purchases is on the Pro screen in the app. Use the same Apple Account you bought Pro with.
  • If Pro ends, every plant you have stays and keeps working. You can't add more than the free garden allows until Pro is on again.

All purchases are made through Apple and are also governed by Apple's terms.

6. Tips

Tips are optional one-time purchases that say thanks. They unlock nothing.

7. Refunds

Purchases are processed by Apple, and we cannot issue refunds ourselves. You can request a refund from Apple at reportaproblem.apple.com. Your statutory rights as a consumer are not affected.

8. Your data

Your garden belongs to you. It is stored on your iPhone and, if iCloud is on, in your own iCloud. We have no copy and cannot recover it for you, so use Export in the You tab if you want a backup. How Filiy handles data is described in the privacy policy.

9. Shared gardens and fair use

Only invite people who want to take part in a shared garden, and don't use plant names or notes to harass anyone. Don't misuse Filiy: don't try to break, reverse engineer or interfere with the app or Apple's services beyond what the law allows.

10. Our rights

Filiy, its design, drawings, plants, code and name belong to us or our licensors. These terms give you a licence to use the app, not ownership of it.

11. Provided as is

Filiy is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We work to keep it reliable, but we can't promise that it is free of errors or that it will run without interruption.

12. Liability

We are liable without limit for intent and gross negligence, for injury to life, body or health, and where mandatory law says so. Otherwise, to the extent the law allows, we are not liable for indirect or consequential loss, and our total liability is limited to the amount you paid for Filiy in the 12 months before the claim. This does not limit your statutory rights as a consumer.

13. Changes to Filiy and these terms

We may update Filiy and these terms. If a change is significant, we will show it in the app or on this page before it applies. The date above shows the latest version.

14. Ending

You can stop using Filiy and delete its data at any time. We may end these terms with reasonable notice, or immediately for serious breaches. Sections 7, 10, 11 and 12 continue to apply afterwards.

15. Law and disputes

These terms are governed by the laws of the Republic of Türkiye. The courts of Istanbul have jurisdiction, except where the consumer protection law of the country you live in gives you the right to bring a claim there. You keep the protection of the mandatory laws of your country of residence.
