Notul Terms of Use
1. These terms
These terms are an agreement between you and Burak Özaslan, who makes Notul at 1801 Labs ("we", "us"). By downloading or using Notul, you agree to them. If you don't agree, please don't use the app.
2. The licence and Apple's Standard EULA
Notul is licensed, not sold, to you through the App Store under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These terms add to the Standard EULA. Where they conflict in a way that affects your rights as an App Store user, the Standard EULA prevails.
You and we acknowledge that:
- These terms are between you and us only, not with Apple. We, not Apple, are solely responsible for Notul and its content.
- Your licence is limited to using Notul on Apple-branded devices that you own or control, as the Usage Rules in the App Store Terms of Service allow.
- Apple has no obligation to provide any maintenance or support for Notul. Support is provided by us (section 18).
- If Notul fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for Notul.
- We, not Apple, are responsible for addressing any claims relating to Notul or your use of it, including product liability claims, claims that Notul fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that Notul or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You agree to comply with any third-party terms that apply when you use Notul, such as your mobile carrier's.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
3. What Notul is
Notul is a private notebook for people who manage others: one card per person, notes, follow-ups, 1:1 sessions, prep cards, templates and review drafts. It is a personal tool. It is not an HR system, a performance-management system or an evaluation tool, and it does not rate, score or rank anyone.
4. Who can use Notul
You can use Notul if you can enter into a binding agreement in your country.
5. Your notes and the people in them
Your notes stay on your devices and in your own iCloud; we never receive them. That also means:
- You are responsible for what you write and how you use it. Notes about the people you manage are personal data about them. Follow your employer's policies and the data protection law that applies to you (for example the GDPR or the KVKK): keep notes factual and to what is needed, have a lawful reason to keep them, respect the rights the law gives the people you write about, and delete notes when they are no longer needed.
- Check whether you may use Notul for work notes. In many workplaces such notes count as the employer's data, and your employer may restrict which tools you can use. Notul shows this reminder in onboarding and in Settings.
- We can't recover your notes. Keep iCloud sync on, or make an encrypted export, if you want a copy. An encrypted export can't be opened without its password, and we can't reset it.
6. Acceptable use
Don't use Notul:
- for covert surveillance or monitoring of anyone, or to record or transcribe conversations;
- as an automated system for evaluating, scoring, ranking or profiling people, or for decisions about people based only on its output;
- to store information you aren't allowed to keep, or to harass or discriminate against anyone.
Don't try to break, reverse engineer or interfere with the app or Apple's services beyond what the law allows.
7. Review drafts
Review drafts are written on your device by Apple's on-device language model from your own dated notes. They are suggestions for you to check and rewrite, not assessments. Drafts can be incomplete or wrong: read every line against the notes it cites, and write the final text yourself. Don't use a draft as an evaluation or as the sole basis for any decision about a person. Review drafts need a device with Apple Intelligence; without it, Notul shows your notes grouped by kind and month.
8. Free features and Notul Pro
Notul is free to download, and the free version is complete for up to nine people on iPhone, iPad and Mac, including review drafts, PDF and Markdown export, iCloud sync and three templates. Notul Pro is optional and adds 10 or more people, all 14 templates, encrypted export and a receipt for your expense report. Prices are shown in the app before you buy, in your local currency.
Notul Pro is offered as:
- Yearly and monthly: auto-renewable subscriptions. There is no free trial.
- Lifetime: a one-time purchase that does not renew.
For the subscriptions:
- Payment is charged to your Apple Account when you confirm the purchase.
- Auto-renewal: a subscription renews automatically for the same period at the end of each period unless it is cancelled at least 24 hours before the period ends. Your account is charged for the renewal within the 24 hours before the period ends, at the same price unless we told you about a change in advance.
- Manage or cancel at any time in your Apple Account settings: on iPhone, Settings → your name → Subscriptions → Notul, or Manage in Notul's Settings. Cancelling stops the next renewal; Pro stays on until the end of the period you paid for.
- Restore purchases is in Notul's Settings. Use the same Apple Account you bought Pro with.
- If Pro ends, your notes are never locked. Pages you opened with a Pro template stay readable and editable; you can't open new Pro pages or add people beyond the free limit until Pro is on again.
All purchases are made through Apple and are also governed by Apple's terms.
9. Refunds
Purchases are processed by Apple, and we cannot issue refunds ourselves. You can request a refund from Apple at reportaproblem.apple.com. Your statutory rights as a consumer are not affected.
10. Your data
How Notul handles data is described in the privacy policy. You can delete everything from Settings at any time.
11. Our rights
Notul, its design, templates, code and name belong to us or our licensors. These terms give you a licence to use the app, not ownership of it. The notes you write are yours.
12. Provided as is
Notul is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We work to keep it reliable and your notes safe, but we can't promise that it is free of errors, that it will run without interruption, or that reminders and review drafts are complete or accurate.
13. Liability
We are liable without limit for intent and gross negligence, for personal injury or harm to health caused by our breach of duty, and where mandatory law says so. Otherwise, to the extent the law allows, we are not liable for indirect or consequential loss, for the content of your notes or decisions you make using them, or for loss of notes you didn't back up, and our total liability is limited to the amount you paid for Notul in the 12 months before the claim. This does not limit your statutory rights as a consumer.
14. Changes to Notul and these terms
We may update Notul and these terms. If a change is significant, we will show it in the app or on this page before it applies. The date above shows the latest version.
15. Ending
You can stop using Notul and delete its data at any time. We may end these terms with reasonable notice, or immediately for serious breaches, such as misuse under section 6. Sections 5, 9, 11, 12 and 13 continue to apply afterwards.
16. Law and disputes
These terms are governed by the laws of the Republic of Türkiye. The courts of Istanbul have jurisdiction, except where the consumer protection law of the country you live in gives you the right to bring a claim there. You keep the protection of the mandatory laws of your country of residence.
17. If part of these terms doesn't apply
If a court finds part of these terms invalid, the rest still applies.
